Terms of Service

General Terms

These General Terms cover every service OWCOL operates. Each service also has a supplement of its own. Read both.

01Who you are agreeing with

The services described here are operated by OWCOL (“OWCOL”, “we”, “us”, or “our”), an independently run provider of self-hosted software. The point of contact for all matters is the OWCOL Administrator at admin@owcol.com.

“You” means the individual using a service, and, where an organization has arranged access on your behalf, that organization as well.

02Acceptance

By creating an account, signing in, or otherwise using any OWCOL service, you agree to these General Terms, to the supplement for each service you use, and to the OWCOL Privacy Policy. Together these form the agreement between you and OWCOL. If you do not agree, do not use the services.

If a service supplement conflicts with these General Terms, the supplement controls for that service only.

04Eligibility and accounts

Who may use the services

Access to OWCOL services is by invitation or approval — there is no open public sign-up. You may use a service only if an account has been provisioned for you, or if you have been granted access by an organization that OWCOL has authorized to do so.

You must be at least 13 years old to hold an account in your own name. Accounts for users under 13 may exist only on OWCOL Canvas and OWCOL SIS, only where a school or parent/guardian has arranged and consented to them, and only under the supervision of that school or guardian.

Your account

• Give accurate information when an account is set up, and keep it current.
• You are responsible for everything done under your account.
• Keep your password and any second factor to yourself. Do not share credentials, and do not let anyone else use your account.
• Tell the administrator promptly at admin@owcol.com if you believe your account has been compromised.
• Most OWCOL services authenticate through OWCOL SSO. Losing access to that account means losing access to the services behind it.

05Acceptable use

You agree not to use any OWCOL service to:

• Break the law, or help someone else break it.
• Store, send, or distribute material you have no right to — including material that infringes copyright, trademark, or other rights.
• Host or transmit malware, ransomware, or other harmful code.
• Send spam, bulk unsolicited email, phishing messages, or anything designed to deceive a recipient about who sent it.
• Harass, threaten, stalk, defame, or incite violence against anyone.
• Store or distribute sexual content involving minors, or any content that sexualizes a minor. This will be reported to the appropriate authorities.
• Attempt to gain unauthorized access to any account, system, or network — ours or anyone else's — or to probe, scan, or test our systems without written permission.
• Interfere with or degrade the service: denial-of-service traffic, deliberate resource exhaustion, circumventing quotas or rate limits, or bypassing authentication.
• Resell, sublicense, or run a commercial service on top of OWCOL infrastructure without written permission.
• Use the service as bulk storage or a distribution point unrelated to its intended purpose — for example, using a mailbox or file share as a public content delivery network.
• Mine cryptocurrency, run distributed computing workloads, or otherwise consume compute unrelated to the service's purpose.

Automated access is permitted only through documented interfaces (for example IMAP, CalDAV, WebDAV, or a published API), at a reasonable rate, and where the service supplement allows it.

These are shared systems with finite capacity. OWCOL may apply storage quotas, sending limits, and rate limits, and may change them as capacity requires.

06Your content

You keep ownership of your content. Files, messages, coursework, records, and anything else you upload or create remain yours. OWCOL claims no ownership of it.

You grant OWCOL only the permission technically necessary to operate the service for you: to store, back up, transmit, render, index, and display your content, and to process it as required by the features you use. That permission ends when the content is deleted, subject to the retention periods described in the Privacy Policy.

You are responsible for having the rights to the content you put on OWCOL systems, and for its legality.

OWCOL does not routinely monitor or review your content, and does not want to. We may review specific content when investigating a report of abuse, responding to a legal request, or diagnosing a technical fault, and we may remove content that violates these terms.

07Availability and changes

OWCOL services are provided on a reasonable-effort basis with no service level agreement. There is no uptime guarantee, no guaranteed support response time, and no promise that any feature will continue to exist.

We may, at any time and without liability to you:

• Take a service offline for maintenance, updates, or repairs, with or without notice.
• Add, change, or remove features, including as a result of upstream software updates.
• Impose or adjust quotas and limits.
• Discontinue a service entirely. Where a service is being retired deliberately, we will make a reasonable effort to give advance notice and a window to export your data.

08Fees

OWCOL services are provided without charge unless a separate written agreement says otherwise. Nothing here obliges OWCOL to keep providing a service free of charge; if paid tiers are ever introduced, existing users will be notified before any charge applies.

09Suspension and termination

By you

You may stop using a service at any time. To have your account closed and your data removed, email admin@owcol.com.

By OWCOL

We may suspend or terminate your access, with or without notice, if you breach these terms, if your use threatens the security, stability, or legality of the service, if required by law, or if the service is being discontinued. Where circumstances allow, we will tell you why and give you a chance to fix the problem first.

Serious abuse — malware distribution, phishing, illegal content, or attacks on our systems or others — will result in immediate termination without notice.

After termination

Your right to use the service ends immediately. Unless the law requires otherwise or an investigation is open, your data will be deleted according to the retention schedule in the Privacy Policy. Sections 6, 12, 13, 14, and 16 survive termination.

10Backups and data portability

OWCOL takes backups of its systems for its own disaster-recovery purposes. Those backups are not a personal backup service, are not guaranteed to be complete or current, and restoring an individual file, mailbox, or record on request is a courtesy rather than an obligation.

11Open-source software

OWCOL services are self-hosted deployments of independent open-source projects. OWCOL is not affiliated with, endorsed by, or sponsored by any of those projects or their owners, and this agreement is between you and OWCOL alone.

• Canvas by OWCOL is an independent deployment of Canvas LMS, a trademark and product of Instructure, Inc..
• Authentik by OWCOL is an independent deployment of authentik, a trademark and product of Authentik Security, Inc..
• Nextcloud by OWCOL is an independent deployment of Nextcloud, a trademark and product of Nextcloud GmbH.
• Mailcow by OWCOL is an independent deployment of mailcow: dockerized, a trademark and product of the mailcow project.
• Rosario SIS by OWCOL is an independent deployment of RosarioSIS, a trademark and product of its respective copyright holders.

All trademarks are the property of their respective owners. The underlying software remains licensed under its own terms; nothing here grants you rights to that software beyond using the OWCOL deployment.

12Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, OWCOL DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

OWCOL does not warrant that the services will be uninterrupted, timely, secure, or error-free, that data will not be lost, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

13Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OWCOL AND ITS ADMINISTRATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES — WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY.

OWCOL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID OWCOL FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Nothing in this agreement excludes liability that cannot lawfully be excluded, including for fraud, willful misconduct, or death or personal injury caused by negligence.

14Indemnification

You agree to indemnify and hold harmless OWCOL and its administrator from any claim, demand, loss, or expense (including reasonable legal fees) arising from your content, your use of the services, or your breach of this agreement or of any law or third-party right.

15Changes to these terms

These terms may be updated as the services change. The current version always lives at docs.owcol.com/terms/, with the effective date shown at the top of each page.

Material changes will be announced by email to affected users or by notice within the service at least 14 days before they take effect, where practical. Continuing to use a service after a change takes effect means you accept the revised terms.

16Governing law

This agreement is governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. You and OWCOL agree to the exclusive jurisdiction and venue of the state and federal courts located in Collin County, Texas for any dispute that cannot be resolved informally, except that either party may seek injunctive relief in any court of competent jurisdiction.

OWCOL is operated from Farmersville, Collin County, Texas.

Before filing anything, please email admin@owcol.com. Nearly everything is resolvable in a message or two.

If any provision of this agreement is found unenforceable, the rest stays in force. A failure to enforce a provision is not a waiver of it. You may not assign this agreement; OWCOL may assign it in connection with a transfer of the services.
